Acceptable Use Policy

This Acceptable Use Policy ("Policy") sets out the rules for using Momently, operated by Kodecraft. It applies to all users, including event hosts and guests who upload or view content. This Policy forms part of our Terms of Service.

Violation of this Policy may result in content removal, event suspension, account termination, and reporting to law enforcement where appropriate.

You may use Momently to:

• Create private event albums for legitimate personal or commercial events
• Share album links or QR codes with invited guests
• Upload photos taken at or related to the event
• View and download photos from events you have been given access to

You must not upload, share, or make available any content that:

• Is illegal under South African law or the law of your jurisdiction
• Depicts or promotes child sexual abuse material (CSAM) or exploitation of minors in any form
• Contains non-consensual intimate images or revenge pornography
• Infringes copyright, trademark, or other intellectual property rights of third parties
• Defames, harasses, threatens, bullies, or discriminates against any person or group
• Promotes violence, terrorism, or hate speech
• Contains malware, viruses, or code designed to harm systems or data
• Includes personal information of others shared without their consent (beyond what is reasonably expected at a social event)
• Constitutes spam, phishing, or fraudulent activity
• Is sexually explicit or pornographic in nature (unless the event host has lawful authority and all participants have given informed consent, and such use complies with all applicable laws)

You must not:

• Attempt to gain unauthorised access to events, accounts, or systems
• Scrape, crawl, or systematically download content from the Service without permission
• Circumvent security measures, rate limits, or access controls
• Use the Service to stalk, surveil, or monitor individuals without their knowledge and consent
• Impersonate any person or entity
• Use automated tools (bots) to upload content or access the Service without our written consent
• Resell, sublicense, or commercially exploit the Service without authorisation
• Interfere with or disrupt the Service or servers

Event hosts are responsible for:

• Controlling who receives the event link or QR code
• Setting appropriate expectations with guests about photo sharing
• Monitoring content uploaded to their event album
• Reporting prohibited content to us promptly
• Ensuring guests comply with this Policy

We are not obligated to monitor all user content but reserve the right to do so and to act on violations.

We respect intellectual property rights. If you believe content on Momently infringes your copyright, please contact us at hello@kodecraft.co.za with:

• Identification of the copyrighted work
• Identification of the infringing content and its location (event link or URL)
• Your contact information
• A statement of good faith belief that use is not authorised
• A statement that the information is accurate and you are authorised to act on behalf of the rights holder

We will investigate and may remove infringing content. Repeat infringers may have their accounts terminated.

To report content or behaviour that violates this Policy, contact:

Include the event link, a description of the violation, and any supporting evidence. We aim to review reports promptly but cannot guarantee a specific response time.

If you believe someone is in immediate danger, contact local law enforcement first.

We may, at our sole discretion and without liability:

• Remove or disable access to violating content
• Suspend or terminate event albums
• Suspend or terminate user accounts
• Report illegal activity to law enforcement or regulatory authorities
• Cooperate with legal investigations

We are not obligated to provide advance notice where immediate action is necessary to protect users, comply with law, or prevent harm.

Momently is a platform that hosts user-uploaded content. We do not endorse, verify, or guarantee the accuracy or legality of user content. Users are solely responsible for content they upload. See our Terms of Service for limitation of liability provisions.

We may update this Policy at any time. Continued use of the Service after changes constitutes acceptance of the updated Policy.
